What to do when your business is being sued

Several parties can sue your business. This can be your customer, employee, partner, shareholder or supplier. You may even face a lawsuit from another company. If you do, it’s crucial to take the appropriate steps to protect your business.

Here is what to do as soon as you know your business is about to face a lawsuit:

Confirm the names listed

When you are served with lawsuit documents, check the names included in them. Typically, they will have your business name (the defendant) and the name(s) of the person who has initiated the lawsuit (the plaintiff). Confirm that the details included are accurate.

Check the reason behind the lawsuit

One of the documents you will be served will be a complaint, which will detail why the other party has taken action against you. Read it carefully to determine the next suitable steps.

Gather evidence

Start collecting any evidence linked to the reason for the lawsuit. For example, if an employee is suing you for wrongful termination, gather the documents that support your decision. If you dismissed them for poor performance, gather their performance evaluation reports and emails you sent warning them of their performance. If a supplier sues you for a breach of contract, get your agreement and examine the terms you allegedly breached, and so forth.
